Rep. Smith's statements reflect his critical stance on issues related to tax policies and political allegations involving Hunter Biden.

On December 4, 2024, Rep. Jason Smith expressed his disapproval of recent changes made by the IRS to the 1099-K reporting requirements. He stated that these changes would "burden taxpayers by burying gig workers under a mountain of paperwork," emphasizing that "over 90% of this tax burden falls on Americans earning less than $200,000." The tweet highlighted Smith's belief that these modifications were implemented unlawfully by Democrats right before Thanksgiving. "Right before Thanksgiving, the IRS unlawfully rewrote Democrats’ wildly unpopular 1099-K reporting requirements which will burden taxpayers by burying gig workers under a mountain of paperwork."

Later on December 4, Rep. Smith addressed President Biden’s comments concerning Hunter Biden's prosecution. He refuted claims that it was politically motivated and asserted that "Hunter Biden wasn't unfairly prosecuted" but rather "unfairly protected by the Biden DOJ for years." This statement underscores Smith's perspective on what he perceives as preferential treatment given to Hunter Biden in legal matters. "President Biden’s allegation that his son’s prosecution was politically motivated is utterly false."

In another post on December 4, Rep. Smith criticized President Biden for allegedly granting leniency to Hunter Biden despite advocating for rule of law principles where no one is above it. He suggested that President Biden provided Hunter with a metaphorical "get out of jail free card," implying special treatment or avoidance of consequences in legal proceedings involving him."After preaching rule of law and insisting nobody is above the law, President Biden has given Hunter Biden a get out of jail free card."
